Beta Disclaimer

EmotionGuard is currently in beta phase and under active development. This means:

  • The platform may contain bugs, errors, or limitations in functionality
  • Features and services are subject to change, modification, or removal without notice
  • System availability and performance may vary during development phases
  • New features may be added or existing features may be modified based on user feedback
  • Data structures and formats may evolve as we improve the platform

Use of the Platform

EmotionGuard provides AI-powered tools to help traders manage their emotional responses during trading. You agree to use our platform only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the service in any way that violates any applicable laws or regulations
  • Attempt to interfere with or disrupt the integrity or performance of the service
  • Attempt to gain unauthorized access to the service or its related systems
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the service
  • Use the service for any purpose other than your personal trading activities

User-Generated Content

You retain all rights to any content you create or submit through EmotionGuard, including journal notes, trade reflections, emotional inputs, tags, and any other user-generated content ("Your Content"). However, by submitting Your Content to our platform, you grant EmotionGuard a worldwide, non-exclusive, royalty-free license to use, copy, modify, and analyze Your Content for the following purposes:

  • Providing and improving our services to you
  • Generating personalized insights and analytics
  • Developing and enhancing our AI algorithms and features
  • Creating aggregated, anonymized data for research and platform improvement
  • Ensuring platform security and preventing misuse

This license allows us to process your data to deliver the core functionality of EmotionGuard while ensuring your ownership rights remain intact. We will never sell or share your personal content with third parties for marketing purposes.

AI & Data Analysis

EmotionGuard uses automated systems, artificial intelligence, and machine learning algorithms to analyze your trading behavior, performance patterns, and emotional inputs. This analysis serves to:

  • Provide personalized insights about your trading psychology and behavior
  • Identify patterns and trends in your trading performance
  • Generate educational content and recommendations
  • Help you understand emotional triggers and their impact on trading decisions
  • Improve the overall functionality and accuracy of our platform

Important Notice: All insights, recommendations, and analysis provided by EmotionGuard are for educational and analytical purposes only. EmotionGuard does not provide financial advice, investment recommendations, or trading signals. We do not make trading decisions on your behalf. All trading decisions remain entirely your own responsibility.

Third-Party Services

EmotionGuard integrates with several third-party services to provide our core functionality. By using our platform, you acknowledge that your data may be processed by these trusted partners:

  • Stripe: For secure payment processing and subscription management. Payment information is handled directly by Stripe according to their privacy practices.
  • Supabase: For backend infrastructure, database management, and user authentication. Your account and trading data is securely stored and processed through Supabase's systems.
  • Resend: For sending transactional emails such as account notifications, password resets, and service updates.
  • Trading Platform Integrations: Data from connected trading platforms (such as MetaTrader) is processed to provide performance analytics and insights.

We only share your data with these services as necessary to provide EmotionGuard's functionality. Each third-party service operates under their own privacy policies and security standards, which we encourage you to review.

User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding the password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

Payment & Subscriptions

EmotionGuard may offer subscription services for premium features. By subscribing to our premium services, you agree to pay the fees indicated for your selected subscription plan. We reserve the right to change subscription fees upon reasonable notice. Subscription fees are non-refundable except as required by law or as explicitly stated in our refund policy.

Refund Policy

We want you to be satisfied with EmotionGuard. Our refund policy includes:

  • 30-Day Money-Back Guarantee: New subscribers may request a full refund within 30 days of their initial subscription purchase.
  • Pro-rated Refunds: In exceptional circumstances, we may provide pro-rated refunds for unused subscription periods at our discretion.
  • Technical Issues: If you experience significant technical problems that prevent normal use of the service, you may be eligible for a refund or service credit.
  • Refund Processing: Approved refunds will be processed within 5-10 business days to your original payment method.

To request a refund, please contact our support team with your account details and reason for the refund request. Refunds are not available for subscriptions canceled after the 30-day guarantee period unless required by applicable law.

Affiliate Program Agreement

This section governs the terms and conditions for all participants in the EmotionGuard affiliate program. By participating in our affiliate program, you agree to comply with the following terms and conditions.

1. Program Overview

The EmotionGuard affiliate program allows approved partners to promote our trading psychology platform and receive commissions for successful referrals. EmotionGuard is a digital analysis tool designed to help traders reflect on and improve their trading behavior through emotional insights and performance tracking.

2. Nature of Service

EmotionGuard does not constitute a financial service and does not provide investment advice or trading recommendations. It is a digital analysis tool for self-reflection and trading behavior improvement. All affiliates must clearly communicate this distinction in their promotional activities.

3. Affiliate Obligations

As an EmotionGuard affiliate, you are required to adhere to the following standards:

  • Prohibited Claims: You must not make misleading statements or promises, including but not limited to:
    • "Guaranteed success with EmotionGuard"
    • "Become automatically profitable using EmotionGuard"
    • "EmotionGuard replaces trading strategies or professional advice"
    • Any promises of specific financial returns or guaranteed profits
  • Clear Communication: You must clearly communicate that EmotionGuard is a supportive tool for trading psychology and self-improvement, not a guarantee of trading success or profitability.
  • Representation: You may not present yourself as an official employee or direct representative of EmotionGuard without written authorization from our team.
  • Paid Advertising: You may not use paid advertising on branded terms such as "EmotionGuard" or related trademarked terms without written approval from EmotionGuard.
  • Compliance with Laws: All promotional activities must comply with applicable laws, regulations, and advertising standards in your jurisdiction.

4. Consequences of Violations

EmotionGuard reserves the right to take the following actions in case of agreement violations:

  • Immediate termination of affiliate access without prior notice
  • Withholding or reversal of earned commissions
  • Legal action if the affiliate's conduct results in reputational or financial damage to EmotionGuard
  • Permanent ban from future participation in the affiliate program

5. Commission Payments & Chargeback Protection

Commission payments are processed 30 days after the successful booking of a Pro Plan subscription by a referred customer. This 30-day holding period protects against chargebacks and aligns with our 30-day money-back guarantee policy. Commissions for subscriptions that are refunded within the guarantee period will not be paid or will be deducted from future commission payments.

6. Program Modifications

EmotionGuard reserves the right to modify the terms of the affiliate program, commission structures, or program availability at any time with reasonable notice to active affiliates. Changes to the program will be communicated through email or affiliate dashboard notifications.

7. Termination

Either party may terminate the affiliate relationship at any time. Upon termination, affiliates must immediately cease all promotional activities for EmotionGuard and remove any promotional materials. Outstanding commissions earned prior to termination will be paid according to the standard payment schedule, subject to the terms outlined in this agreement.

Beta Pricing Policy

EmotionGuard is currently in beta phase with special introductory pricing for early adopters. The following terms apply to our beta pricing structure:

  • Price Protection for Active Subscribers: Current subscribers who maintain active subscriptions will continue to pay their original beta pricing rates even after we increase prices for new subscribers.
  • Beta Pricing Availability: Beta pricing is only available during our beta period and may be discontinued at any time without prior notice.
  • Price Increases for New Subscribers: We reserve the right to increase subscription prices for new subscribers at any time after the beta period ends.
  • Loss of Beta Pricing Upon Cancellation: If you cancel your subscription and later decide to resubscribe after price increases have taken effect, you will be charged the current market price, not the original beta price. Beta pricing protection only applies to continuously active subscriptions.
  • No Retroactive Beta Pricing: Beta pricing cannot be restored for accounts that have been canceled, even if the cancellation was brief or accidental.
  • Payment Method Changes: Updating payment methods or making changes to your subscription billing details will not affect your beta pricing protection as long as your subscription remains active.

Important Notice: By subscribing during our beta period, you acknowledge and understand that canceling your subscription will result in the permanent loss of beta pricing benefits. We strongly recommend maintaining your subscription to preserve your beta pricing advantage.

Intellectual Property

The EmotionGuard platform, its original content, features, functionality, and design elements are and will remain the exclusive property of EmotionGuard and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of EmotionGuard.

Cookies & Tracking

EmotionGuard uses cookies and similar tracking technologies to enhance your experience, analyze platform usage, and provide personalized features. These technologies help us:

  • Remember your login preferences and settings
  • Analyze how you interact with our platform to improve functionality
  • Provide security features and prevent fraud
  • Deliver relevant content and recommendations

You can control cookie settings through your browser preferences. However, disabling certain cookies may limit your ability to use some features of EmotionGuard.

Data Rights

You have certain rights regarding your personal data and account information:

  • Access: You can request access to the personal data we hold about you.
  • Export: You can request a copy of your data in a structured, machine-readable format.
  • Correction: You can update or correct inaccurate personal information in your account settings.
  • Deletion: You can request deletion of your account and associated data, subject to legal retention requirements.

Limitations of Liability

EmotionGuard and its suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of (or inability to access or use) the service. EmotionGuard does not guarantee that the service will be uninterrupted, timely, secure, or error-free. You acknowledge that trading involves risk, and EmotionGuard does not provide financial advice.

Termination

We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our service after any revisions become effective, you agree to be bound by the revised terms.

Governing Law & Jurisdiction

These Terms & Conditions are governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions. Any legal disputes, claims, or proceedings arising out of or relating to these Terms or your use of EmotionGuard shall be exclusively resolved in the competent courts of Dubai, United Arab Emirates.

You consent to the personal jurisdiction of the Dubai courts and waive any objection to the laying of venue in such courts. If any provision of these Terms is found to be unenforceable or invalid under applicable law, such provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
